Nova Voice Terms of Service
This document applies to the Nova Voice ("NV") service and any future services created by the Mojavesoft Nova Voice team ("we", "our", "us"). By creating an account or accessing the service, you agree to be bound by, and henceforth accept these Terms of Service ("ToS").
1. Account Creation, Eligibility, and Transferability
To access the full features of Nova Voice, you must create an account by providing a valid username and email address. You must be at least 13 years of age (or the legal minimum age in your jurisdiction) to create an account. If you are under the age of 13, you may not use the service.
Creating a new account to evade an active ban or account termination is strictly prohibited.
Accounts may not be bought, sold, or commercialized. However, account access may be transferred upon death or legal incapacity via:
- A valid Will or Transfer-on-Death (TOD) document;
- A Digital Asset Memorandum or Digital Estate Plan; or
- A Power of Attorney containing a Digital Assets Clause referencing RUFADAA.
Designated family members or legal representatives requesting account transferral must contact us with valid legal documentation.
2. Educational Use
Educators may apply for a specialized Edu Account. Edu Accounts are intended solely for instructional and classroom use and may not be used as personal accounts outside of an active class setup.
3. User Content & Intellectual Property
You retain all ownership rights to any audio recordings, text, or data ("User Content") you transmit through Nova Voice. By uploading or transmitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your content strictly for the purpose of operating and providing the service to you.
All original software, code, interface design, logos, and trademarks related to Nova Voice remain the exclusive property of Mojavesoft Nova Voice and its licensors.
4. Prohibited Conduct
You agree not to use Nova Voice to engage in, promote, or facilitate any illegal or harmful activities, including but not limited to: harassment, cybercrime, distribution or use of illegal substances, non-consensual sexual content, or unlawful behavior. See Appendix A for detailed platform rules.
5. Disclaimer of Warranties
THE NOVA VOICE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR SOLE RISK AND DISCRETION.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOJAVESOFT NOVA VOICE AND ITS DEVELOPERS SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY USER CONDUCT OCCURRING ON OR OFF THE PLATFORM.
If you encounter illegal content or behavior that violates these terms, please submit a report using the in-app reporting feature.
7. Service Modifications & Availability
We continuously aim to improve Nova Voice. We reserve the right to modify, update, temporarily suspend, or permanently discontinue any part of the service at any time, with or without notice, and without liability to users.
8. Termination
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for conduct that violates these Terms of Service.
9. Changes to These Terms
We may modify these Terms of Service from time to time. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of Nova Voice after changes have been posted constitutes your acceptance of the revised terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable local laws, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of competent jurisdiction.
Appendix A: Community Rules & Conduct
All users must strictly adhere to the following community standards. Failure to abide by these rules will result in account warnings, suspension, or permanent ban:
- No Illegal Acts: Do not use Nova Voice to conduct, organize, or promote any illegal activity under local or international law.
- No Harassment or Cybercrime: Harassment, stalking, doxxing, cybercrime, or NSFW acts are strictly prohibited on the platform.
- Anti-Bigotry Policy: Hate speech, discrimination, bigotry, or targeted harassment based on identity will not be tolerated. Nova Voice is an inclusive space and must remain LGBTQ+ friendly. Queer slurs are strictly prohibited.
Appendix B: Moderator's Rights
The moderators of Mojavesoft Nova Voice have the rights to:
- Ban,
- Mute users,
- Take away user permissions, and
- can NOT abuse these rights. If a moderator has abused these rights, please, contact us.
